Digital Transformation of the Right of Assembly: Constitutional Protection of Freedom of Assembly and Digital State Assembly Regulation and Communication
Synopsis
This paper deals with the effects of digital communication possibilities on the right of assembly.
On the one hand, its constitutional guarantee of protection is examined: Communication aimed at creating spontaneous collectivity. It is shown that this does not prescribe a mode of physicality, but also includes digital communications under certain conditions (online conferences, chat groups, etc.). For these international, digital assembly matters, the protection dimensions must be effectively determined, especially in the private law user relationship with the platform operators.
On the second level, the question arises as to whether simple (assembly) law covers digital assemblies and what rules govern digital police assembly communication on social networks.
